Our designated territory covers Montana, North Dakota, Wyoming, Utah, Colorado, New Mexico, Oklahoma, Texas, and Louisiana. Investment in a rural area carries advantages written into the statute itself.
Twenty percent of the annual EB-5 allocation is set aside for investors in rural areas, alongside 10 percent for high-unemployment areas and 2 percent for infrastructure.
USCIS is directed to prioritize the processing and adjudication of petitions for rural areas — not a discretionary courtesy, but a statutory instruction.
Any area outside a metropolitan statistical area, and outside the boundary of any city or town of 20,000 people or more.
Reserved visas, priority adjudication, and the definition of a rural area are set by 8 U.S.C. § 1153(b)(5), as amended by the EB-5 Reform and Integrity Act of 2022.
